PHILADELPHIA — A former employee is suing Drug and Alcohol Rehabilitation Services Inc., doing business as Dars Inc., citing alleged violation of civil rights.
Wilfredo Lozano filed a complaint on Sept. 18, in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the Pennsylvania company breached its duty of good faith and fair dealings.
According to the complaint, the plaintiff alleges that he was subjected to discrimination and harassment on the basis of his race and origin prior to his termination as head supervisor on Dec. 22. 2017, causing plaintiff to suffer from mental anguish, severe emotional and psychological distress, and loss of self-esteem.
The plaintiff holds Dars Inc. responsible because the defendant allegedly acted with malice and reckless disregard for plaintiff's protected rights, interfered with employee's contractual right to enjoy the same benefits and privileges as other employees, and terminated plaintiff in bad faith without reasonable grounds.
The plaintiff requests a trial by jury and seeks judgment against defendant, equitable relief, compensatory damages, costs of action, attorney's fees, and further relief deemed just. He is represented by James A. Bell IV and Christopher A. Macey Jr. of Bell & Bell LLP in Philadelphia.
