Damaged mailbox leads to web of litigation

PITTSBURGH — An Allegheny County resident is suing Zokaites Contracting and Robinson Law Group, citing an alleged wrongful use of proceedings, violations of the Dragonetti Act and civil conspiracy while seeking punitive damages. 

Franco Moscatiello filed a complaint on Sept. 26 in the Court of Common Pleas of Allegheny County against the defendants, alleging they made false representation of fact in pleadings and other legal papers. Moscatiello lives in a house built by Zokaites.

He filed a complaint against the company in 2016 in magistrate court, alleging an employee of Zokaites damaged his mailbox, resulting in a judgment of more than $1,600.

Zokaites and its attorney, Robinson Law Group, has filed a writ in the Court of Common Pleas challenging the magistrate's decision.

A judge found Zokaites and the Robinson firm had engaged in vexatious litigation by bringing three arguments for which they did not provide evidence, the lawsuit says. Moscatiello is seeking damages related to this.

The plaintiff seeks punitive damages against each defendant in an amount in excess of $1 million. He is represented by Sean Audley of Audley Law Offices P.C. in Pittsburgh.
