MEDIA — A daughter and her mother are suing Carter's Open Arms Child Care Center, citing alleged negligence.
Jayde Whitaker, a minor, by and through her parent and natural guardian, Chardae Barkley, and Chardae Barkley in her own right filed a complaint on Oct. 4, in the Delaware County Court of Common Pleas against the defendant, alleging it failed to maintain a safe environment for their invitees.
According to the complaint, the plaintiffs allege that on Oct. 9, 2016, Jayde Whitaker was an invitee at defendants premises when she was injured. She suffered a laceration on her left small finger, partial fingertip amputation through the nail, and contusion and abrasions, the suit says.
The plaintiffs hold Carter's Open Arms Child Care Center responsible because it allegedly failed to maintain an appropriate ratio of supervisors to children and negligently allowed them to play in an unsafe area.
The plaintiffs request a trial by jury and seek judgment against the defendants, jointly and severally, in an amount in excess of the arbitration limits of the court. She is represented by Benjamin Hoffman of Clearfield & Kofsky in Philadelphia.
