Misericordia University is accused of disability discrimination, wrongful termination

WILKES-BARRE — A former project manager is suing Misericordia University, an educational institution, citing alleged age and disability discrimination, retaliation and wrongful termination.

Marcia Siana Frank filed a complaint on Oct. 4 in the U.S. District Court for the Middle District of Pennsylvania against Misericordia University, alleging the educational institution violated the Age Discrimination in Employment Act and the Pennsylvania Human Relations Act.

According to the complaint, the plaintiff alleges that on June 19, 2015, she was discharged from her employment. She has suffered lost wages and employment benefits, loss of seniority, emotional distress, embarrassment and humiliation. The plaintiff holds Misericordia University responsible because the defendant allegedly failed to provide reasonable accommodation; terminated her employment due to her age and disability; and replaced her with a non-disabled, younger associate.

The plaintiff requests a trial by jury and seeks all damages, attorney's fees, costs, expenses, interest and such other fair and appropriate relief. She is represented by Jonathan Comitz, Jeremy Weinstock and Rachael Litchman of Comitz Law Firm LLC in Wilkes-Barre.
