Woman says she slipped on coffee, sues Wawa in Boothwyn

PHILADELPHIA — A public invitee is suing Wawa Inc. and Wawa Store No. 30, citing alleged negligence.

Jeanette Totaro filed a complaint on Oct. 8 in the Philadelphia County Court of Common Pleas against the defendants, alleging they failed to maintain the store premises reasonably safe for their invitees. The defendants recently removed the case to Philadelphia federal court.

According to the complaint, the plaintiff alleges that on Nov. 26, 2016, she was a public invitee at defendants' convenience store in Boothwyn when she slipped and fell on coffee that was spilled on the floor. She suffered serious and permanent injuries to her head, back and left knee, she says.

The plaintiff holds Wawa Inc. and Wawa Store No. 30 responsible because the defendants allegedly failed to properly and timely clean up the spilled coffee on the floor and failed to barricade that area or to give warning or notice of such danger.

The plaintiff requests a trial by jury and seeks damages of more than $50,000, with interest, costs, attorney's fees and all other appropriate relief. She is represented by Christopher Heavens of Heavens Law Firm PLLC in Boothwyn.
