Dietary aide sues Forbes Center, former supervisor after alleged assault

PITTSBURGH — A dietary aide is suing Forbes Center for Rehabilitation and Health Care LLC and Denise Turner, her former employer and supervisor, citing alleged assault and battery.

T.H., by and through her parent Danielle Hall, filed a complaint on Oct. 11 in the Allegheny County Courts of Common Pleas against the defendants, alleging they wrongfully discharged her for engaging in protected activity.

According to the complaint, the plaintiff alleges that T.H. was a minor who was a dietary aide employed by defendant, Forbes Center, when she was severely injured both physically and emotionally. She was terminated on Aug. 27. 

The plaintiff holds Forbes Center for Rehabilitation and Health Care LLC and Denise Turner responsible because Turner allegedly assaulted, battered and intentionally inflicted emotional distress at her place of employment and defendant Forbes failed to properly investigate and respond to plaintiff's report of assault and battery by defendant Turner.

The plaintiff requests a trial by jury and seeks actual damages of more than $35,000, plus punitive damages, with interest and such other just and proper relief. She is represented by Brian Benestad of HKM Employment Attorneys LLP in Pittsburgh.
