PHILADELPHIA — A Nottingham man is suing an auto parts store, citing alleged negligence.
Daniel Spisak filed a complaint on Oct. 10 in the U.S. District Court for the Eastern District of Pennsylvania against Advance Auto Parts Inc., alleging the property controller failed to maintain its premises free of any unreasonable dangers and/or hazards.
According to the complaint, the plaintiff alleges that on Dec. 22, 2017, he was at defendant's property when he slipped and fell due to the presence of ice and/or snow in the parking lot.
He says he sustained serious and permanent injuries to his right shoulder, elbow and arm. The plaintiff holds Advance Auto Parts Inc. responsible because the defendant allegedly negligently permitted the accumulation of ice and/or snow on parking lot; failed to perform timely shoveling, plowing or salting to make the condition safe; and failed to give adequate notice of the existing danger.
The plaintiff requests a trial by jury and seeks damages in an amount in excess of the jurisdictional limits of the court, with interest, and such other just and appropriate relief. He is represented by Louis Silverman and John Trotman Jr. of Silverman Trotman & Schneider LLC in Philadelphia.
