PHILADELPHIA — A courier service provider is suing Sunovion Pharmaceuticals Inc., an international company, citing alleged breach of a master service agreement.
Yourway Transport Inc. filed a complaint on Oct. 9 in the U.S. District Court for the Eastern District of Pennsylvania against Sunovion Pharmaceuticals Inc., alleging the international company failed to tender payment.
According to the complaint, the plaintiff alleges that beginning in October 2017, plaintiff provided courier services to defendant in the total amount of $141,478, but failed to receive payments due to alleged errors and missing data.
On Sept. 27, defendant indicated its intent to remit payment in the amount of $77,717, with the express condition that plaintiff would accept it as full and final payment, to which plaintiff disagrees, the suit says. The plaintiff holds Sunovion Pharmaceuticals Inc. responsible because despite requests for payments, defendant has failed and continues to refuse to make a payment.
The plaintiff requests a trial by jury and seeks compensatory damages of more than $75,000, plus interest and costs. It is represented by Steven Angstreich and Amy Brandt of Weir & Partners LLP in Philadelphia.
