Lawsuit filed over fight at rooftop bar in Lancaster

PHILADELPHIA — A customer is suing The Orsini Group LLC, d/b/a Altana Rooftop Lounge, and John Doe I and John Doe II, individuals, citing alleged negligence.

Edwin Gonzalez Jr. filed a complaint on Sept. 25 in the Lancaster County Court of Common Pleas against the defendants, alleging they failed to follow applicable safety guidelines and regulations.

According to the complaint, the plaintiff alleges that on May 14, 2017, he was at defendant Orsini's Altana Rooftop Lounge at 480 New Holland Ave. in Lancaster with a female acquaintance when he was assaulted by Defendants John Doe I and John Doe II. Gonzalez says the assailants punched him and hit him in the face with a beer bottle without warning. As a result of the incident, plaintiff has suffered bodily injury; was deprived of ordinary pleasures of life; lost earnings; and has permanent scarring. 

The plaintiff holds defendants responsible for failing to properly supervise and monitor the actions of its employees, failing to implement a proper system of security protocol, failing to intervene during the physical attack on the plaintiff, and failing to timely respond to the verbal argument involving its customer.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount in excess of $50,000, plus interest, costs of suit and other relief as the court deems just. He is represented by Tobi Russeck and Matthew Richards of Bern Cappelli LLC in Conshohocken.
