Former police officer files discrimination suit against City of Johnstown

PITTSBURGH — A former police officer is suing the City of Johnstown, Craig Foust and Melissa Komar, local municipality and city officials, citing alleged retaliation and violation of the Uniformed Services Employment and Reemployment Rights Act.

Scott Haymaker filed a complaint on Oct. 9 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging they breached its duty of good faith and fair dealing.

According to the complaint, the plaintiff alleges that he suffered embarrassment, humiliation, emotional distress, damage to his reputation, lost wages, benefits and other remuneration, and was subjected to discrimination in employment as a result of the wrongful conduct of the defendants in denying him promotional opportunities to the position of captain and/or chief of the Johnstown Police Department on the basis of his military service. 

The plaintiff holds City of Johnstown, Craig Foust and Melissa Komar responsible because the defendants allegedly showed reckless disregard for plaintiff's right to be free from discrimination and/or retaliation on account of his reserve obligations.

The plaintiff requests a trial by jury and seeks judgment against defendants for damages in excess of $50,000, including compensatory and punitive damages. He is represented by Edward Olds and Jamie George of Old Russ Marquette & Peace in Pittsburgh and Timothy O'Brien of The O'Brien Law Firm in Pittsburgh.
