Shopper says she fell in Lancaster Tanger Factory Outlet Center parking lot

PHILADELPHIA — A Virginia resident is suing Tanger Factory Outlet Centers Inc., citing alleged premises liability and negligence.

Donna Goewey filed a complaint on Oct. 9 in the U.S. District Court for the Eastern District of Pennsylvania against Tanger Factory Outlet Centers Inc., alleging it failed to provide a safe environment for its business invitees.

According to the complaint, the plaintiff alleges that on Oct. 6, 2017, she was walking through the parking lot of defendant's establishment located at 311 Stanley K. Tanger Drive in Lancaster when she fell due to the defective condition of the walking surface or the lack of sign and/or the presence of the decline from the median to the paved asphalted street. 

As a result of the incident, plaintiff injured her left shoulder and arm, which was shattered in multiple places and required surgical intervention; and suffered from physical impairment, financial detriment, embarrassment, humiliation, pain, instability, additional falls, suffering, agony, inconvenience and incurred medical expenses, the suit says. 

The plaintiff holds Tanger Factory Outlet Centers Inc. responsible because the defendant allegedly failed to properly inspect, discover and remedy the defective condition of the walking surface, and failed to warn invitees of the dangerous condition that existed.

The plaintiff requests a trial by jury and seeks judgment against defendant in excess of $75,000, and the award of actual, special, compensatory, incidental, consequential and punitive damages, exemplary damages, attorney's fees and costs, interest, costs, and fees allowed by the law, and such other relief as the court deems just. She is represented by Mu'min Islam of Mei Law Group PLLC in Philadelphia.
