Consultant sues Illinois laboratory for breach of contract

PHILADELPHIA — A consultant is suing On Target Laboratories and Martin Low, an Illinois company and its manager, citing alleged breach of contract, misappropriation of trade secrets, and unjust enrichment.

Northeast Industries LLC and Joseph DeLuca filed a complaint on Oct. 10 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging they breached its duty of good faith and fair dealings.

According to the complaint, the plaintiffs allege that Northeast Industries LLC and Joseph DeLuca has suffered economic injury as a result of entering into a consulting contract with the defendants in May 2015 to aid in marketing the company, developing partnerships, developing the business itself and raising capital. However, the defendants unlawfully induced plaintiffs to reveal proprietary contacts, methodology, technique, know-how, processes and proprietary expertise for their own benefit without properly compensating plaintiffs as agreed upon, the suit says.

The plaintiffs hold the defendants responsible because they allegedly made false promises to give a bonus to plaintiffs for positive financing result; misappropriated plaintiffs' trade secrets; disavowed that any consulting contract was ever in place; and obtained and enjoyed the value of time, energy and proprietary information and strategy from plaintiffs without paying proper compensation.

The plaintiffs request a trial by jury and seek judgment against defendant in an amount to be determined at trial, plus pre-judgment and post-judgment interest, costs of suit, and for such other relief as the court deems equitable and just. They are represented by Peter Kessler and Oliver Griffin of Kutak Rock LLP in Philadelphia.
