Produce team member sues Whole Foods for disability discrimination

PHILADELPHIA — A produce team member is suing Whole Foods Market Group Inc., citing alleged disability discrimination, retaliation and wrongful termination.

Logan Maynard filed a complaint on Oct. 16 in the U.S. District Court for the Eastern District of Pennsylvania against Whole Foods Market Group Inc., alleging the former employer violated the American with Disabilities Act and the Pennsylvania Human Relations Act.

According to the complaint, the plaintiff alleges that on April 14, 2017, he was terminated from his employment just three days before his return to work schedule. He has suffered loss of earnings and employment benefits, mental anguish, emotional distress, and pain and suffering, the suit claims. 

The plaintiff holds Whole Foods Market Group Inc. responsible because the defendant allegedly failed to engage in an interactive process to determine a reasonable accommodation for his disability and retaliated against him by terminating his employment for requesting a reasonable accommodation.

The plaintiff requests a trial by jury and seeks damages of not less than $150,000, plus interest, and such other just and equitable relief. He is represented by Michael Murphy of Murphy Law Group LLC in Philadelphia.
