Electrolux, Lowe's named as defendants in lawsuit over dryer fire

PHILADELPHIA — A licensed insurer is suing Electrolux Home Products Inc. and Lowe's Home Centers, citing alleged strict liability.

Philadelphia Contributionship Insurance Co., as subrogee of Chi T. Le, filed a complaint on Oct. 16 in the Philadelphia County Court of Common Pleas against the defendants, alleging they negligently distributed a product that was not safe for its intended use.

According to the complaint, the plaintiff alleges that on Sept. 23, 2016, plaintiff's subrogor was operating a ball-hitch clothes dryer that was purchased from defendants when it suddenly ignited, causing a fire. Plaintiff's subrogor's real and personal property was substantially damaged and he was caused to suffer additional hardship and all other consequential and incidental damages, the suit says. 

The plaintiff holds Electrolux Home Products Inc. and Lowe's Home Centers LLC responsible because the defendants allegedly failed to provide adequate information of the safety and fire risk associated with the ball-hitch clothes dryer.

The plaintiff requests a trial by jury and seeks damages of more than $50,000, interest, costs and such other just and appropriate relief. He is represented by Patrick Hughes of de Luca Levine LLC in Blue Bell.

The Philadelphia County Court of Common Pleas Case No. is 2:18-cv-04436-JHS.
