PHILADELPHIA — A patient is suing Clinical Reference Laboratory and WorkCompvidence LLC, citing alleged negligence.
Peter Pantalone filed a complaint on Oct. 17 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging they failed to use due care in collecting, testing and analyzing plaintiff's urine sample.
According to the complaint, the plaintiff alleges that on Oct. 6, 2017, he provide WorkCompvidence a urine sample for an employment drug test, which was analyzed by Clinical Reference Laboratory. As a result of the incompetent testing, plaintiff's employer terminated his employment, causing him to sustain damages, the suit says.
The plaintiff holds Clinical Reference Laboratory and WorkCompvidence LLC responsible because the defendants allegedly negligently collected and tested plaintiff's urine sample that resulted in false-positive for methadone.
The plaintiff requests a trial by jury and seeks compensatory and punitive damages of not less than $50,000. He is represented by Wayne Ely of Kolman Ely PC in Penndel.
