Guest with disability sues Marriott, says bed was too high

PHILADELPHIA — A guest with a disability is suing Marriott International Inc., citing alleged negligence and premises liability.

Mary Ann Hrinko filed a complaint on Oct. 18 in the U.S. District Court for the Eastern District of Pennsylvania against Marriott International Inc., alleging the lodging company failed to uphold Americans with Disabilities Act regulations.

According to the complaint, the plaintiff alleges that on July 12 she was a paying hotel guest at defendant's Courtyard by Marriott Atlantic City when she fell while trying to get into the bed. She suffered injuries including but not limited to hematoma in her left leg, which required surgical intervention and hospitalization for more than a week, the suit says. 

The plaintiff holds Marriott International Inc. responsible because the defendant allegedly breached its duty to provide a room designed to accommodate a disabled guest by negligently putting her in a room that has a bed that was too high to be safely used.

The plaintiff requests a trial by jury and seeks damages of more than $150,000, interest, costs and delay damages. She is represented by Joseph Schwartz of Silver & Silver in Ardmore.
