WILKES-BARRE — A telecom and internet network provider is suing Quadix LLC, an IT company, citing alleged breach of contract and quantum meruit/unjust enrichment.
AT&T Corp. filed a complaint on Oct. 12 in the U.S. District Court for the Middle District of Pennsylvania against Quadix LLC, alleging the IT company is indebted to AT&T for ethernet point to point and other telecom services in the amount of $132,642.36.
According to the complaint, the plaintiff alleges that between August 2015 and November 2017, AT&T Corp. provided 10G Ethernet Point to Point Services to two locations designated by QUADIX at 9 E. Market St. in Wilkes-Barre and 401 N. Broad St. in Philadelphia.
AT&T demanded payment for the charges under the accounts, but allegedly received no part of the balance due. The plaintiff holds Quadix LLC responsible because the defendant allegedly accepted and benefited from their services.
The plaintiff seeks judgment for the sum of $132,642.36, plus accrued interest from the date due at the contractual rate of 1.5 percent per month (18 percent per annum) or the maximum rate allowed by law. It further seeks for collection costs, including attorneys’ fees; and for such other and further relief as the court may deem just and proper.
