Truck owner claims he was battered during repossession of his vehicle, sues towing company

PITTSBURGH — A truck owner is suing Credit Acceptance Corp. and United Towing Service LLC, citing alleged violations of Fair Debt Collection Practices Act, Fair Credit Extension Uniformity Act and Uniform Commercial Code, as well as battery and conversion/trespass.

Jeffrey Synan filed a complaint on Oct. 12 in the Court of Common Pleas Allegheny County against the defendants, alleging they "forcibly seized the truck over plaintiff's protest, intentionally driving him over – fracturing his foot – in a singular, violent effort to seize the Plaintiff's truck at a time when the remaining loan balance was less than $500," the suit says.

According to the complaint, the plaintiff alleges that on July 16, "Credit Acceptance Corp. — through its agent, United Towing Service LLC — used force and violence by intentionally driving over Mr. Synan’s leg and left foot, to accomplish the repossession of plaintiff's truck." The plaintiff holds Credit Acceptance Corp. and United Towing Service LLC responsible because the defendants allegedly have no present right to repossess Synan's 2007 Chevrolet Colorado.

The plaintiff requests a trial by jury and seeks damages, including treble damages, actual damages, punitive damages, attorney's fees, and cost plus other and further relief as the court deems just and proper.
