Philadelphia passenger sues Uber, says driver threw her out of car

PHILADELPHIA — A customer is suing Uber Technologies Inc., citing alleged breach of duty and negligence.

Stephanie Torres-Fountain filed a complaint in the Philadelphia County Court of Common Pleas against Uber Technologies Inc., alleging the transport service provider did not comply with a court order injunction to cease and desist operation within the city of Philadelphia. The defendant removed the case to Philadelphia federal court in October.

According to the complaint, the plaintiff alleges that on Oct. 7, 2016, she was being transported by defendant's driver named Emmanuel Ameh when an argument ensued. Ameh pulled and drug her out of the car and threw her to the ground, the suit says. 

She suffered injury to both knees that required surgery, post-traumatic stress, fright, nightmares and loss of sleep, she says. The plaintiff holds Uber Technologies Inc. responsible because the defendant allegedly unlawfully continued to operate its point to point transportation network service at the time she was assaulted and failed to protect her from its dangerous employee/agent.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000, costs, interest and punitive damages. She is represented by Scott McIntosh of Lewis McIntosh & Teare LLC in Royersford.
