ERIE — A Punxsutawney couple are suing Speedway LLC, citing alleged negligence.
Monty Allen Snair and Jaime L. Snair filed a complaint in the Venango County Courts of Common Pleas against Speedway LLC, alleging the convenience store owner failed to eliminate a dangerous condition. The defendant removed the case to Erie federal court on Oct. 18.
According to the complaint, the plaintiffs allege that on Dec. 13, 2016, Monty Allen Snair was an invitee at defendant's Speedway No. 2921 when he was caused to slip, trip and fall as a result of a defective condition of the premises.
Allegedly, he sustained injuries including, but not limited to, spinal stenosis of the lumbar region, first grade anterolisthesis of L5 on L6 (S1) and anterior wedge like compression of L1 body. The plaintiffs hold Speedway LLC responsible because the defendant allegedly negligently caused and permitted the dangerous condition to exist on the premises for an unreasonable period of time and failed to give adequate warning about it.
The plaintiffs request a trial by jury and seek damages in an amount in excess of the jurisdictional limits of the court, costs, interest and such other just and equitable relief. They are represented by Richard Talarico of Woomer & Talarico LLC in Pittsburgh.
