Beer bottle exploded into man's eye, Erie lawsuit says

ERIE — A South Carolina man is suing 40401 Corp. LLC, d/b/a Erie Brewing Co., and South Erie Beer Inc., citing alleged breach of warranty.

John Fralic filed a complaint on Oct. 25, in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging they negligently placed a defective product into the steam of commerce.

According to the complaint, the plaintiff alleges that on June 15, he purchased a six-pack of defendant Erie Brewing's Soleil Shandy beer from defendant South Erie Beer. As he was attempting to place one bottle into a cooler, it suddenly exploded, the suit says. 

He sustained serious and permanent injuries including, but not limited to, blunt force trauma to the left eye and severe shock to his entire nervous system. The plaintiff holds 40401 Corp. LLC, d/b/a Erie Brewing Co., and South Erie Beer Inc. responsible because the defendants allegedly failed to appropriately inspect the subject Soleil Shandy bottle for potential defects and failed to ensure that it would not cause a danger to potential third parties.

The plaintiff requests a trial by jury and seeks judgment in his favor in an amount in excess of $75,000 and such other appropriate relief. He is represented by Anthony Giannetti of Swartz Culleton PC in Pittsburgh.
