PITTSBURGH — A patron is suing Pittsburgh Nightlife Group LLC, t/d/b/a Cavo Nightclub, a restaurant operator, citing alleged negligence.
Allen Dade filed a complaint on Nov. 1 in the Allegheny County Courts of Common Pleas against Pittsburgh Nightlife Group LLC, t/d/b/a Cavo Nightclub, alleging the restaurant operator failed to properly supervise the action and conduct of its security personnel.
According to the complaint, the plaintiff alleges that on Feb. 4, 2017, he was at defendant's Cavo Nightclub with a group of friends when security workers physically accosted him on the dance floor. He sustained a fracture to his tibia and damage to ligaments and ankle that required corrective surgery, the suit says.
He has suffered pain and suffering, disfigurement, embarrassment and loss of pleasure in life, the suit says.
The plaintiff holds Pittsburgh Nightlife Group LLC, t/d/b/a Cavo Nightclub, responsible because the defendant allegedly failed to implement adequate security protocols and negligently hired incompetent employees so as to expose patrons to unreasonable risk of harm.
The plaintiff requests a trial by jury and seeks judgment against defendant in an amount in excess of the jurisdictional limits for arbitration. He is represented by C.J. Engel of Swensen & Perer in Pittsburgh.
