Woman says she slipped on ice in a Walmart parking lot

PHILADELPHIA — A business invitee is suing Wal-Mart Stores East LP, citing alleged negligence.

Dorothea David filed a complaint recently in the Philadelphia County Court of Common Pleas against Wal-Mart Stores East LP, alleging the retailer breached its duty to maintain its store premises in a reasonably safe condition. The defendant removed the case to federal court on Nov. 9.

According to the complaint, the plaintiff alleges that on March 2, she slipped and fell on snow or ice at defendant's Walmart store parking lot premises in Norristown. She sustained serious and permanent injuries to her neck, shoulders, arm and ribs, the suit says. 

The plaintiff holds Wal-Mart Stores East LP responsible because the defendant allegedly failed to properly monitor, inspect or clean the parking lot premises and failed to provide adequate warning of the dangerous nature of the premises.

The plaintiff requests a trial by jury and seeks damages of more than $50,000, costs and such other proper and just relief. She is represented by Marc Simon of Simon & Simon PC in Philadelphia.
