PHILADELPHIA — A Pine Grove couple are suing Walmart Inc., Wal-Mart Store No. 2535 and others, citing alleged negligence.
Judith C. Hiester, and Roy R. Hiester filed a complaint recently in the Philadelphia County Court of Common Pleas against Walmart Inc., Wal-Mart Store No. 2535, et al, alleging the multinational retailers failed to maintain the store premises in a reasonably safe condition. The defendants removed the case to Philadelphia federal court Nov. 9.
According to the complaint, the plaintiffs allege that on Aug. 23, 2016, Judith Hiester slipped and twisted her back within a cashier aisle due to water on the floor. She suffered serious and painful injuries to her back and damage to her bones, muscles and nervous system, she says.
Roy Hiester has been deprived of his wife's assistance, companionship and services, the suit claims. The plaintiffs hold Walmart Inc., Wal-Mart Store No. 2535, et al, responsible because the defendants allegedly failed to properly inspect its premises to discover water on the floor, failed to place barricades, and kept an aisle open with the dangerous condition and failed give proper or due notice of existing danger.
The plaintiffs request a trial by jury and seek judgment against defendants in an amount in excess of the arbitration limit, plus interest, costs and delay damages. They are represented by J. Davy Yoc of J. Davy Yockey PC in Trevose.
