Business owner sues Daniels Discount Hardware for alleged negligence

PITTSBURGH — A business owner is suing Daniels Discount Hardware, an appliance dealer, citing alleged nuisance and negligence.

McLane Contracting Inc. filed a complaint Nov. 16 in the Allegheny County Courts of Common Pleas against Daniels Discount Hardware, alleging the appliance dealer failed to avoid blocking a bridge underpass.

According to the complaint, the plaintiff alleges that on June 20, plaintiff sustained damages to its real and personal property and business due to flooding. Plaintiff was caused to suffer damages in excess of $35,000. The plaintiff holds Daniels Discount Hardware responsible because the defendant allegedly failed to secure its garbage dumpster and storage container that obstructed the free flow of water in the creek bed.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, and any further relied as the court deems just and proper. It is represented by Michael Farnan of Farnan Law in Pittsburgh.
