PHILADELPHIA — A consumer is suing Raymour & Flanigan and Hillsdale Furniture LLC,  retailers, citing alleged breach of implied and express warranties.

Theresa Taurino filed a complaint on Nov. 27 in the Philadelphia County Court of Common Pleas against the defendants, alleging they failed to comply with their own instructions and warnings.

According to the complaint, the plaintiff alleges that on June 15, 2017, she was sleeping on the top bunk bed when she fell approximately 5 feet, landing on both of her wrists.

She was caused to suffer a right wrist fracture of the distal radius, avulsion of triquetrum and left wrist sprain that required three surgeries, the suit says. The plaintiff holds Raymour & Flanigan and Hillsdale Furniture LLC responsible because the defendants allegedly negligently provided and installed a wrong-sized mattress on a poorly designed bed frame that did not have a barrier.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount exceeding $50,000, excluding interest, attorney's fees and costs. She is represented by Joseph Marano of Freiwald Law PC in Philadelphia.

The Philadelphia County Court of Common Pleas Case No. 2:18-cv-05115-JS.
