PITTSBURGH — A business invitee is suing Sheetz, Inc., citing alleged negligence.
Karen Tubio filed a complaint on Dec. 6, in the Allegheny County Court of Common Pleas against Sheetz Inc., alleging the property occupier breached its duty to maintain its premises in a reasonably safe condition.
According to the complaint, the plaintiff alleges that on Sept. 22, 2017, she was legally upon defendant's premises when she slipped and fell on a puddle of water near the refrigerator. She sustained serious injuries resulting in pain, sickness, emotional distress, loss of earnings, and medical related expenses, the suit says.
The plaintiff holds Sheetz Inc. responsible because the defendant allegedly failed to properly monitor the pathways to discover the dangerous condition and make it safe, and failed to block off the dangerous area of the premises.
The plaintiff requests a trial by jury and seeks judgment against defendant in an amount in excess of $35,000, plus costs and such other just and proper relief. She is represented by Marc Simon of Simon & Simon PC in Pittsburgh.
