Insurance company claims contractor's botched fireplace led to fire damage

PHILADELPHIA — A liability insurer is suing Al-Kaz Inc., a contractor, citing alleged breach of contract and breach of warranty.

State Farm Fire and Casualty Co., a/s/o Istvan Ujvara, filed a complaint on Nov. 30 in the U.S. District Court for the Eastern District of Pennsylvania against Al-Kaz Inc., alleging the contractor failed to take necessary and reasonable precautions in order to safeguard plaintiff's insured property from the risk of fire.

According to the complaint, the plaintiff alleges that on Jan. 23, plaintiff's insured property in Moscow was damaged by a fire that originated near the fireplace. Plaintiff made payments to its subrogor totaling approximately $180,000, the suit says.

The plaintiff holds Al-Kaz Inc. responsible because the defendant allegedly failed to properly and competently install the fireplace/chimney system in conformance with industry standards.

The plaintiff requests a trial by jury and seeks judgment in its favor in the approximate amount of $180,000, costs, interest, attorney's fees and such other proper and appropriate relief. It is represented by Daniel de Luca of de Luca Levine LLC in Blue Bell.
