Delivery man claims he was defamed by General Electric; He's accused of stealing a fridge

PHILADELPHIA — A delivery man is suing General Electric Co., citing alleged defamation.

Efrain Alvarez filed a complaint on Dec. 3 in the U.S. District Court for the Eastern District of Pennsylvania against General Electric Co., alleging the industrial company breached its duty of good faith and fair dealings.

According to the complaint, the plaintiff alleges that in June he suffered the loss of his contracted position with H2B/TB & G as a delivery person due to defendant's cancellation of his work assignment with them and the lack of work thereafter. 

He also suffered severe emotional distress, depression, anger, and tarnished reputation, as a result of the wrongful and malicious conduct of the defendant in accusing him of stealing a refrigerator without any reasonable basis or evidence and despite the surveillance cameras proving his innocence, the suit says. 

Additionally, he suffered further harm by defendant's dissemination to his co-workers, peers and at least one customer that he was restricted from making further deliveries because he was dismissed from his contracted employment with the defendant, the suit says.

The plaintiff holds General Electric Co. responsible because the defendant allegedly singled plaintiff out for theft without any basis or evidence to determine that he has stolen the refrigerator, and failed to conduct a thorough investigation of the case to prove his innocence or discover facts.

The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory and punitive damages, and other relief as the court deems appropriate. He is represented by Reginald Allen, Attorney At Law in Philadelphia.
