SCRANTON — A Scarsdale couple are suing CBK Lodge LP, owner of indoor waterpark Aquatopia, citing alleged negligence and premises liability.
Suada Lalic and Ismet Lalic filed a complaint on Dec. 18 in the U.S. District Court for the Middle District of Pennsylvania against the defendants, alleging the indoor waterpark owner breached its duty to protect its business invitees from foreseeable harm.
According to the complaint, the plaintiffs allege that on Feb. 20, 2017, Suada Lalic was a business invitee at defendant's premises when she suffered injuries when the FlowRider malfunctioned. Allegedly, she suffered severe injuries to her back, left hip, and left foot and Ismet Lalic has been denied the society and consortium of his wife.
The plaintiffs hold CBK Lodge LP responsible because the defendant allegedly failed to inspect the FlowRider and discover its dangerous condition and make its safe and failed to provide adequate warning of any existing danger.
The plaintiffs request a trial by jury and seek judgment against the defendant in an amount exceeding $75,000, with interest, costs and any other appropriate relief. She is represented by Jonathan Russell of Drake Hileman & Davis PC in Doylestwon.
