Shopper sues Petco following alleged fall in the defendant's store

PITTSBURGH — A woman is suing Petco Animal Supplies Stores Inc., a pet food store operator, citing alleged negligence and premises liability.

Sharon Smith filed a complaint on Jan. 2 in the U.S. District Court for the Western District of Pennsylvania against Petco Animal Supplies Stores Inc., alleging the pet food store operators failed to keep its store premises in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on Jan. 25, 2018, she was legally in the defendant's pet food store in Greensburg when she tripped and fell over a flatbed cart along an aisle. 

She allegedly suffered serious and permanent injuries to her legs, elbow, neck and back. The plaintiff says the defendant failed to remove the flatbed cart from the aisle and failed to give adequate warning of the existence of an unsafe condition.

The plaintiff requests a trial by jury and seeks judgment agains defendant in an amount greater than $75,000, plus costs and such other just and necessary relief. She is represented by Amanda Neese of Simon & Simon PC in Philadelphia.
