Butler County couple say they're tired of Penn Energy's noise, file nuisance lawsuit

PITTSBURGH — A Butler County couple are suing Penn Energy Resources LLC, an oil and gas exploration company, citing alleged private nuisance.

Joseph R. and Michelle L. Zandarski filed a complaint on Dec. 25 in the Allegheny County Court of Common Pleas against Penn Energy Resources LLC, alleging interference with private use and quiet enjoyment of their property.

According to the complaint, the plaintiffs allege that Joseph R. and Michelle L. Zandarski suffered loss of use and quiet enjoyment of their property, diminution in value of the same, annoyance, inconvenience, mental anguish, stress and anxiety. 

The plaintiffs hold Penn Energy Resources LLC responsible because the defendant allegedly failed to use noise reduction equipment, failed to prevent pollutants from traveling onto plaintiffs' property, and failed to limit overnight work activities.

The plaintiffs request a trial by jury and seek compensatory damages, with interest, attorney's fees, costs and such other just and proper relief. They are represented by James Heneghan of Bordas & Bordas in Pittsburgh.
