Modell's Sporting Goods shopper says she was injured by falling display model

PHILADELPHIA — A woman is suing New Era and unknown individuals and companies, citing alleged negligence.

Gabrielle Murphy filed a complaint on Dec. 31, in the U.S. District Court for the Eastern District of Pennsylvania against the defendants alleging they failed to follow applicable safety guidelines and regulations.

According to the complaint, the plaintiff alleges that on Dec. 29, 2016, she was lawfully at Modell's Sporting Goods at 1608 Walnut St. in Philadelphia when a display model designed, manufactured, sold and installed by defendants fell on her. As a result of the accident, she suffered serious injuries, including a bruised kidney that resulted in blood in her urine, back and thigh strain, the suit says. 

She required inpatient hospitalization, missed work, and incurred significant medical expenses, she says.

The plaintiff says the defendants failed to design a display that could be properly mounted for the intended space, and failed to regularly check the display to ensure it remained secure.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount in excess of $75,000. She is represented by Leonard Hill of Hill & Associates in Philadelphia.
