Laborer sues Amtrak, claiming unsafe work environment

PHILADELPHIA — A laborer is suing National Railroad Passenger Corp., aka Amtrak, a transportation service provider, citing alleged negligence and unsafe work environment.

Kerwin Colon filed a complaint on Jan. 10 in the U.S. District Court for the Eastern District of Pennsylvania against National Railroad Passenger Corp., alleging the transportation service provider failed to provide a safe place to work.

According to the complaint, the plaintiff alleges that on May 17, 2018, he was attempting to lift a trashcan that was improperly and overly loaded with metal components when he sustained aggravation of and/or complete umbilical hernia that required surgical repair. 

The plaintiff holds National Railroad Passenger Corp. responsible because the defendant allegedly failed to provide proper and safe lifting procedure and failed to require workers to discard metals components in a metal recycling container.

The plaintiff requests a trial by jury and seeks damages in excess of $150,000, plus costs and fees. He is represented by Michael Olley and Lawrence Katz of Coffey, Kaye, Myers & Olley in Bala Cynwyd.
