MEDIA — A citizen and resident of the Commonwealth of Pennsylvania is suing Upper Darby Township and Aqua America Inc., d/b/a Aqua Pennsylvania, a government subdivision and water utility company, citing alleged premises liability.
Roxann Smith filed a complaint on Jan. 10 in the Court of Common Pleas for Delaware County against the defendants, alleging they were negligent and careless in the maintenance of its premises.
According to the complaint, on Nov. 20, 2018, the plaintiff suffered severe and permanent bodily injury when she tripped and fell on a traffic sign. The plaintiff holds Upper Darby Township and Aqua America Inc., d/b/a Aqua Pennsylvania, responsible because the defendants allegedly failed to exercise the proper care, custody, and control of the premises.
The plaintiff requests a trial by jury and seeks an amount in excess of $50,000, attorney's fees, costs and further relief the court may find just. She is represented by David Kwartler of Kwartler Manus LLC in Philadelphia.
