Worker sues telescopic ladder distributor Regal Ideas for alleged brain injury

PHILADELPHIA — A worker is suing Regal Ideas Inc. and other companies, citing alleged negligence and product liability.

Jonathan M. Malcolm filed a complaint in the Montgomery County Court of Common Pleas against the defendants, alleging they failed to design, manufacture and distribute telescopic ladders of sufficient strength to support a load of 300 lbs.

The defendants removed the case to Philadelphia federal court on Jan. 16.

According to the complaint, the plaintiff alleges that on Aug. 16, 2016, he was using the telescopic ladder on a driveway when both side rails completely fractured and split, causing him to fall and strike his head and body on the driveway. 

He allegedly sustained multiple injuries, including but not limited to traumatic brain injury, fractured skull, clavicle and seven ribs, collapsed lung and hearing loss. The plaintiff says the defendants failed to give adequate warnings regarding the danger of rail fracture and failed to provide sufficient instructions on how to safely use the ladder.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount greater than $50,000, with interest and costs. He is represented by Harold Semanoff of Semanoff Ormsby Greenberg & Torchia in Huntington Valley.
