PHILADELPHIA — A laborer is suing Weldlogic Inc. and other companies, citing alleged negligence and product liability.

Austin Carlile filed a complaint on Jan. 16 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging they negligently distributed a steel-bending machine that was not safe for its intended use.

According to the complaint, the plaintiff alleges that on Oct. 11, 2018, he was using defendants Weldlogic @R-1420 machine when it suddenly and without warning pulled his left hand into a pitch point, traumatically crushing and severing his left pointer finger.

He allegedly sustained skin degloving on his left index finger with exposed tendon, nail plate avulsion on the left thumb and an open distal phalanx fracture. The plaintiff says the defendants failed to install safeguards to prevent access to dangerous moving machine components and failed to provide adequate warnings and instructions on how to safely operate the Weldlogic machine.

The plaintiff requests a trial by jury and seeks judgment against defendants, and each of them, for a sum of more than $75,000. He is represented by Robert Mikel Caplan of White and Williams LLP in Philadelphia and Scott Breidenbach of Breidenbach Associates in Pottstown.

The U.S. District Court for the Eastern District of Pennsylvania Case No. is 5:19-cv-00225-JLS.
