Daughter claims Brightview Senior Living's negligence led to mother's death

PHILADELPHIA — An estate administrator is suing Brightview Senior Living LLC, a senior living facility, citing alleged negligence and wrongful death.

Dale Baumwoll, administrator of the estate of Leatice Brenner, deceased, filed a complaint on Jan. 16 in the U.S. District Court for the Eastern District of Pennsylvania against Brightview Senior Living LLC, alleging the senior living facility failed to properly train its employees and/or associates concerning the emergency response process.

According to the complaint, the plaintiff alleges that on Nov. 28, 2017, Leatrice Brenner fell in the bathroom of her apartment unit at defendant's facility in Randolph, New Jersey. She suffered brain hemorrhages, severe bruising and lacerations that resulted in heavy bleeding, the suit says.

As a result of defendant's conduct, her injuries became untreatable, which resulted in her death on Jan. 3, 2018, the suit says. The plaintiff holds Brightview Senior Living LLC responsible because the defendant allegedly failed to provide timely and proper medical treatment and failed to notify plaintiff or any family member of the emergency.

The plaintiff requests a trial by jury and seeks damages in an amount exceeding $75,000, with interest, costs, attorney's fees and such other just and equitable relief. He is represented by Brent Weiand of Wieand Law Firm in Philadelphia.
