Contractor alleges West Jefferson Hills School District breached contract

PITTSBURGH — A construction company is suing the West Jefferson Hills School District, citing alleged breach of contract.

Gito Inc., d/b/a Nello Construction Co., filed a complaint in the Court of Common Pleas of Allegheny County against West Jefferson Hills School District, alleging the school district failed and refused to issue appropriate extensions of time and pay the amounts due resulting from its various contract breaches.

According to the complaint, the plaintiff alleges that on Feb. 16, 2016, it entered into a contract with the defendant to perform general contracting services for the construction of a new high school on Clairton Road in Jefferson Hills.

Plaintiff's work should have started after the completion of Phase 1, but several delays were encountered that caused the plaintiff to incur substantial financial damages, the suit says. The plaintiff holds West Jefferson Hills School District responsible because the defendant allegedly breached the contract and caused extensive delays, including but not limited to failure to adhere to the phasing and/or scheduling requirements of the contract.

The plaintiff requests a trial by jury and seeks an amount in excess of the arbitration limits of $35,000 plus interest, attorney's fees and other relief the court deems appropriate. It is represented by Dean Falavolito of Carnegie.
