PHILADELPHIA — A paintless dent removal company is suing Porterfield's Collision Center Inc. and Sherry Porterfield, automobile body repair service providers, citing alleged conversion, theft and unjust enrichment.
National Hail & Dent Removal LLC filed a complaint on Jan. 24 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging they continued to retain payments due to plaintiff despite knowing that the same was due and payable to plaintiff.
The plaintiff alleges that between May 22 and July 18, 2018, it provided paintless dent removal services to about 48 automobiles belonging to defendants, who are based in West Virginia, or their customers. After all proper credits for payments and allowances, the sum of $41,407 remains due and owing, the suit says.
The plaintiff holds Porterfield's Collision Center Inc. and Porterfield responsible because despite repeated demands for payments, the defendants allegedly continued to refuse to pay and withhold payments due to plaintiff.
The plaintiff requests a trial by jury and seeks judgment against defendants in the amount of $41,407, plus treble damages, interest, costs and attorney's fees payable at $450 per hour. It is represented by Brad . Tabakin of TabakinWolfe LLP in Plymouth Meeting.
