Contract 09

PHILADELPHIA — A property owner is suing a recreational vehicle dealership, citing alleged breach of contract, negligence and unjust enrichment.

Paul Bellina filed a complaint on Jan. 23 in the U.S. District Court for the Eastern District of Pennsylvania against Tilden Recreational Vehicles LLC, d/b/a Boat-N-RV, alleging the dealership failed in its duty to market and sell plaintiff's trailer.

According to the complaint, the plaintiff alleges that on Dec. 22, 2017, he suffered damages including loss of value to his property, costs of commencing an action, loss of the quiet enjoyment, costs of paying a loan secured against the trailer and diminution of value of property, as a result of the wrongful conduct of the defendant in its duty to properly market and sell his 2014 Aerolite Travel Trailer.

According to the lawsuit, plaintiff's vehicle was discovered by a friend upon a visit to defendant's premises to have been intentionally taken off the sale lot and left broken with several pieces of electronic equipment missing and stolen.

The plaintiff holds Tilden Recreational Vehicles LLC, d/b/a Boat-N-RV, responsible because the defendant allegedly failed to properly secure and safeguard plaintiff's property, and failed to timely notify plaintiff of the damages on his vehicle.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages in an amount in excess of $50,000, treble damages, costs and fees. He is represented by Sean McDonough of Easton.

The U.S. District Court for the Eastern District of Pennsylvania Case No. is 19-cv-349.
