PHILADELPHIA — A woman has filed a class action lawsuit against The Boeing Co., citing alleged failure to comply with Americans with Disabilities Act regulations.
Katrina Hartley filed a complaint on Jan. 25 in the U.S. District Court for the Eastern District of Pennsylvania against The Boeing Co., alleging the company discriminated against her based on her disability.
According to the complaint, the plaintiff sustained significant damages as a result of the wrongful conduct of the defendant in rescinding the offer of employment toward plaintiff on account of her perceived disability, despite her having complied with all of defendant's pre-employment testing and screening and documenting a physicians' clear opinion that she had no physical limitations that would have prevented her from performing her duties.
The plaintiff holds The Boeing Co. responsible because the defendant allegedly refused to provide information or copies of medical records that were used to determine her disqualification; refused to provide employment due to plaintiff's perceived disability; and refused to acknowledge physicians' indication that plaintiff has no physical restrictions.
The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory damages in a sum greater than $150,000, punitive damages, interest, attorney's fees, costs of suit and further relief as the court deems just.
