PHILADELPHIA — A widow is suing Sunrise of Lafayette Hill and others, citing alleged breach of duty and negligence.
The estate of Richardson Mapes, by and through his executrix, Jean E. Mapes, filed a complaint in the Montgomery County Court of Common Pleas against the defendants, alleging they breached their duty of care to ensure protection and reasonable accommodations to prevent injuries to their residents.
The defendant removed the case to Philadelphia federal court on Feb. 1.
According to the complaint, on Nov. 5, 2017, Richardson Mapes was admitted to Sunrise's facility due to his fragile physical condition and susceptibility to significant and serious injuries. While in the care of defendants, decedent allegedly sustained a serious fall that resulted in severe and debilitating injuries including, but not limited to, a neck fracture and head injury that caused decedent to suffer until his death.
Jean Mapes allegedly suffered the loss of the services, support and consortium of her spouse. The plaintiff holds Sunrise of Lafayette Hill and others responsible because the defendants allegedly negligently allowed a dangerous and unsafe circumstances to occur in their facility and failed to secure decedent from falling.
The plaintiff requests a trial by jury and seeks damages of defendants in a sum in excess of $50,000. She is represented by Francis O'Neill Jr. of Van der Veen, O'Neill, Hartshorn & Levin in Philadelphia.
