Contractor files legal action seeking payment from Aegis Security Insurance and Plavchak Construction

PITTSBURGH — A construction materials supplier is suing an insurance and construction company, citing alleged breach of contract and violation of Commonwealth Procurement Code Claims.

Extech/Exterior Technologies Inc. filed a complaint on Jan. 25 in the Allegheny County Court of Common Pleas against Aegis Security Insurance Co. and Plavchak Construction Co. Inc., alleging they failed to pay plaintiff in a timely manner.

According to the complaint, on April 4, 2017, Extech/Exterior Technologies Inc. entered into a contract with Plavchak to supply laminated glass glazing systems for Plavchak's project with the Port of Authority of Allegheny County. Plaintiff claims it adequately supplied the required materials and performed the needed services, but has not received the payment due. 

The plaintiff holds Aegis Security Insurance Co. and Plavchak Construction Co. Inc. responsible because the defendants allegedly failed to pay the balance owed of $43,332. Aegis allegedly issued a payment bond for the project on behalf of Plavchak and agreed to make payment to all claimants under the payment bond for all material and labor supplied to the project.

The plaintiff requests a trial by jury and seeks an amount in excess of $35,000 arbitration limits, together with Pennsylvania Procurement Code interest, penalty interest, costs, attorneys' fees and other further relief the court deems just and necessary. It is represented by Thomas Weirs Jr. of Sewickley.
