AVK Enterprises technician claims he was severely injured by a fallen light fixture on a worksite

PITTSBURGH — A man is seeking damages from property managers, citing negligence after he was allegedly injured while leaving a worksite when a light fixture fell and pinned him on the ground.

Vincent Heck filed a complaint on Feb. 14 in the Court of Common Pleas of Allegheny County against AVK Enterprises Ltd., Krey Properties, Krey Development Co., Clifford Krey and Cynthia Krey for alleged negligence in property management and failure to prevent an incident from taking place. 

The complaint states that on March 22, 2017, the plaintiff was completing a server update for one of his clients. As the plaintiff was leaving his office in Sewickley, the light fixture above him allegedly fell out of the ceiling, striking the plaintiff and causing him to fall backwards and strike his head on the steps, making him lose consciousness and suffer pain in his shoulders and head. 

The plaintiff was allegedly pinned under the fixture and had to carefully lift it, but found that he had a severe laceration in his right foot that caused blood loss. After removing the fixture, the plaintiff allegedly lost consciousness a second time due to the blood loss and trauma that he had suffered.

The plaintiff alleges the fixture was caused to fall due to a dangerous defect that should have been known of and fixed. The defendant was allegedly negligent through failing to adequately warn the plaintiff of the risk; failing to maintain the property, including but not limited to the maintenance of the light fixtures; and failing to remedy the situation before an incident took place. 

The plaintiff seeks judgment against the defendants in an amount in excess of applicable arbitration limits. The plaintiff is represented by Anthony C Mengine.
