PHILADELPHIA – A Willow Grove man is suing a telemarketing company alleging it unlawfully called him to solicit its business.
Stewart Smith, individually and on behalf of all others similarly situated, filed a complaint on March 19 in the U.S. District Court for the Eastern District of Pennsylvania against EGV Cos. Inc. citing the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges he received unsolicited phone calls to his cellphone from the defendant in February and March to solicit him into purchasing an auto warranty. He alleges he has never given the defendant his phone number or his permission to call him.
He alleges he was harmed by an invasion of privacy.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs and trial by jury. He is represented by Barry Cohen of Royer Cooper Cohen Braunfeld LLC in Philadelphia.
