PITTSBURGH – A limited liability company headquartered in Colorado is asking a state court to confirm a $21.7 million arbitration award.
BLV Chaffee Corners LLC filed a petition to confirm arbitration award and enter judgment on March 6 in the Allegheny County Court of Common Pleas against Repsol Oil & Gas USA LLC.
According to the complaint, the parties are successors in interest to parties in a joint exploration agreement to develop and explore oil and gas leasehold interests and under the agreements, the parties agreed that all disputes would be resolved through arbitration.
The filing alleges that the defendant breached the agreement in 2014 by bringing in its own gas from outside wells without compensating the plaintiff or receiving consent. The petition states the plaintiff served a demand for arbitration on the defendant on July 10, 2017, and on Dec. 7, 2018, the panel found the plaintiff was entitled to $19.9 million in damages.
The petition states the panel issued a final award to the plaintiff on Jan. 18 of an additional $1.1 million in attorneys' fees and other costs.
The plaintiff is seeking for the court to confirm the awards and enter a judgment against the defendant for $21.7 million.
