Former JetBlue employee alleges it did not accommodate splint after work-related injury

PITTSBURGH – A Midland woman is seeking reinstatement to her employment with JetBlue after she was allegedly discharged because she was unable to return to work with an accommodation for a work-related injury.

Rebecca Vidovich filed a complaint on Feb. 9 in the Allegheny County Court of Common Pleas against JetBlue Airway Corp. citing the Americans with Disabilities Act.

According to the complaint, the plaintiff began her employment with the defendant on June 1, 2006. She alleges she sustained a hyperextension injury to her right thumb on July 2, 2012, while performing her duties by lifting a heavy suitcase. She alleges she needed surgery and her orthopedic physician recommended she use a thumb splint while working. She alleges she can perform her job with this accommodation.

The plaintiff alleges her physician released her for full duty with the use of the thumb splint, but her supervisors informed her she cannot use it. She alleges the defendant subjected her to discriminatory conduct by refusing to accommodate the splint and discharged her in July 2015.

The plaintiff is seeking reinstatement to her employment, all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Allen Andrascik in Beaver Falls.
