Company seeks payment of $77K arbitration award

PHILADELPHIA — A Montgomery County company says a Mississippi man has failed to pay an award determined in arbitration.

Intellisystem LLC, John W. Lee and Andrew B. Sacks filed a complaint on April 1 in the U.S. District Court for the Eastern District of Pennsylvania against William B. McHenry Jr.

According to the complaint, the plaintiff is seeking damages for an incident that began on April 26, 2016, when the defendant signed an exclusive distributor agreement in which McHenry's Ascension was named the principal and agreed to pay $100,000 to the plaintiff for rights to distribute a medical product. 

The defendant allegedly made false accusations against the plaintiff and began an arbitration. The dispute went to arbitration, which favored the plaintiff for $77,713.13. The defendant has, to date, failed to pay the plaintiff the award, the petition says.

The defendant is accused of breach of contract.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Jeremy E. Abay of Sacks, Weston Diamond LLC in Philadelphia.
