Harry S. Cohen & Associates alleges law firm failed to honor fee-sharing agreement

PITTSBURGH – A Pittsburgh attorney and his law firm allege they were not paid more than $700,000 for fees after a case they worked on with another firm was settled.

Harry S. Cohen and Harry S. Cohen & Associates P.C. filed a complaint in the Allegheny Court of Common Pleas against J. Kerrington Lewis, Mary Ann Lewis and Lewis & Lewis P.C., doing business as Lewis, Lewis & Reilly, alleging breach of contract, unjust enrichment and tortious interference.

According to the complaint, Cohen and J. Kerrington Lewis agreed in June 2015 to both represent a woman's medical malpractice claim and equally split the fee. The suit states on July 23, 2018, the Allegheny Court of Common Pleas approved a $4.25 million settlement in the case, plus $1.4 million in attorneys' fees and a reimbursement of more than $16,000 in costs to Mary Ann Lewis. 

The plaintiffs allege the defendants breached the fee agreement by failing to pay them half of the $1.4 million in attorneys' fees.

The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. They are represented by Gary A. Butler of Massa Butler Giglione in Pittsburgh.
